How do the conditions work in practice?

An example makes this concrete. Suppose a forwarder organizes transport from Rotterdam to Birmingham and a pallet is damaged along the way due to incorrect loading. The shipper submits a damage claim. According to the FENEX conditions, the forwarder has limited liability, and the compensation is calculated per kilogram of damaged goods. There is therefore no discussion about the amount of the claim, as the rules were agreed upon in advance.

Another example concerns delay. A shipment arrives later than agreed, and the client holds the forwarder liable for consequential damages, such as production downtime. The FENEX conditions usually exclude liability for consequential damages, meaning the forwarder does not have to cover indirect losses. This is clear for both parties and prevents an incident from escalating into a long-term conflict.
